According to AILA, on Tuesday, May 3, 2006, the “SKIL Bill” (Securing
Knowledge Innovation and Leadership Bill) was introduced by Senator Cornyn (R-
TX). The aim of the SKIL Bill is to reform both the H-1B visa and employment
based (EB visa) green card processes. Among the provisions in the SKIL Bill
are the following:
• Exemptions for U.S. educated foreign workers with advanced degrees in
math, science, technology and engineering fields from the H-1B and EB quotas;
• Market-based H-1B cap;
• Extension of foreign students' post curricular optional practical
training from 12 to 24 months to allow them to go more easily from student to
green card; and
• Exemptions for EB/green card immigrant spouses and children from the
annual cap.
We are pleased with the Senate’s attempt to ameliorate and improve the
current immigrant condition set for aliens with advanced degree. With the
introduction and hopefully the passage of the “SKIL Bill”, we believe that
it will significantly benefit the applicants of employment-based immigration
with advanced degree as well as their dependents.
