According to an answer letter from Vermont Service Center to AILA's Service Center Operations (SCOPS) Committee on October 26, 2006, those H1b applicants filed on May 26, 2006 and were not selected randomly for processing can return their I-129 petitions and filing fees to VSC to capture those unused H1B quota reserved for Chile and Singapore.
The VSC has mailed a letter notifying applicants that it has retained the I- 129 petition and supporting documentation that was submitted with the initial filing and providing guidelines for re-filing for the H-1B. Applicants are required to return a copy of the letter, along with filing fees, to the VSC by November 14, 2006. If the attorney or petitioner does not receive a copy of this letter by November 8, 2006, and knows that the filing was received May 26, 2006, the VSC can be contacted using the designated e-mail address vsc.h1bcaphelpdesk@dhs.gov, which will be monitored through November 14, 2006.
