对于EB-1a, EB-1b及NIW三种不同的申请，NIW应该是最困难的，但也可能是最容易的一
种，听起来很矛盾，但事实上你若是能掌握重点，就不困难，因为NIW没有EB-1类似明
确的要求。如果你把CIS的审理手册拿来看，你会发现连CIS在这部分所讨论的都很模糊
，而且有很多地方的事实都相违背。CIS明明说到要求审理时“leave the application
of this test as flexible as possible”。当然flexible的解释也可以说是移民官
可以按自己的意思来行事。在这样的情形之下，我们常常看到移民官各抒己见。而且在
以前我们曾经有过同个案件送二份，得到的答案却完全不同。有时客人会说某人程度比
我差，都批了，为何我的NIW却没批。在手册上面CIS说了一段很有意思的话“each
determination must be made on a case-by-case basis and will depend on an
assessment of the specific facts presented.”更有意思的是CIS说the petitioner
might be able to demonstrate that the need for the alien’s service is so
great that the national interest would not be properly served were the
petitioner required to postpone employment of the alien until the labor
certification process is completed.” 从字面上看起来好像你只要PERM拖太久，你
就可以用NIW来申请。事实上，你还必须要证明你个人的资格，符合其它的条件，这点
才用得上，这是一般申请人都不了解的地方。
在整个NIW的申请CIS最要看得是申请人是否证明prospective national benefits. It
clearly must be established that the alien’s past record justifies
projections of future benefit to that national interest…the national
interest can not suffice to establish prospective national benefit if the
alien has few or no demonstrable achievements. 在这里CIS对于NIW的要求是一个
金字塔式的。你要证明过去的成就，才能凸显对于未来的贡献，因此才能符合NIW的条
件，至于怎么准备NIW我们之前已经讨论很多，所以不再多说。基本上申请人要交代清
楚，过去 + 现在的成就 = 未来的贡献。
