关于调整《J-1签证豁免申请办法》(修订稿)的通知

经批准,自2014年3月1日起调整《J-1签证豁免申请办法》(修订稿)(详情请见本网
站“J-1签证豁免”栏目),现就有关事项通知如下:

即日起,驻美使(领)馆教育处(组)启用纽约中国留学服务中心“J-1签证豁免”在
线申请审核系统。今后,凡向我处申请“J-1签证豁免”人员,均需登陆纽约中国留学
服务中心网站(网址:www.chinesehighway.com ),在线提交申请信息,并将书面申
请材料邮寄至纽约中国留学服务中心办理。2014年3月1日之前已经寄出的申请(以邮戳
为准),仍按原途径受理、审批。

J-1签证豁免申请办法(修订稿)

2014年3月1日

第一条 J-1 签证及其豁免

J-1 签证是美国移民局发给外国人来美学习、进修或从事研究工作等的签证种类之一。
美国政府规定,凡持 J-1 签证来美的人员,在美停留期满后必须返回原所在国居住两
年。由于某些原因在美停留期限需超过签证规定时间的人员,应向美国政府提出免除返
回原所在国居住两年限制的豁免申请,但首先须得到原所在国政府的批准。

中国驻美大使馆及各总领馆代表中国政府受理和审批持J-1签证中国公民的豁免申请。
具体审批事宜由中国驻美使领馆教育处组(以下简称驻美使领馆教育处组)根据有关规
定负责办理。


第二条 申请人的资格与条件
(一)中华人民共和国公民,申请时持中华人民共和国有效因私护照;
(二)来美途径属于留学;
(三)在驻美使领馆教育处组有注册登记记录;
(四)与国内原所在单位结清经济、住房等关系,并已协商解决其他未了事宜。

第三条 申请及受理程序
根据工作需要,驻美使领馆教育处组委托纽约中国留学服务中心(以下简称“纽约中
心”)具体负责J-1签证豁免申请的咨询与材料初审工作。具体如下:
(一) 提交申请材料。
1、申请人登陆纽约中心网站new.chinesehighway.com,在线填写《留学人员豁免申请
表》和《个人书面申请报告》,并打印签字。 申请人书面申请报告应写明原国内单位
、高中毕业后简历、留学方式(自费、单位公派或其他)、留学类别(访问学者、学生
或其他)来美后工作或学习简要情况以及申请豁免的理由。
2、申请人登陆目前居留地所在领区的使领馆教育处组网站进行留学人员报到注册,在
线填写《驻美使领馆教育处组留学人员注册登记表》并打印。暂居第三国人员按照原在
美留学单位地址确定所属领区。(附:中国驻美使领馆领区图、驻美使领馆教育处组网
站)
3、现持护照有效页、来美第一次J-1签证页、最近一次来美签证页、现有I-94卡复印件

4、首次及目前所持DS2019(原IAP-66)表的复印件;
5、美国务院豁免编号页 (THIRD PARTY BARCODE PAGE)。
(二)申请人在线申请成功后将所有申请材料邮寄到纽约中心。

(三)驻美使领馆教育处组对材料进行审核,同意后由驻美使馆教育处代表中国政府统
一向美国国务院出具“不持异议信”(NO- OBJECTION STATEMENT ),并由纽约中心将
结果通知申请人。

第四条 港澳地区申请者
按照“一国两制”的原则并考虑到港澳地区在户籍制度及行政管理上的实际情况,港
澳地区申请者申请时无需说明与原工作单位情况,申请材料可用中文或英文填写。

第五条 暂居第三国留学人员申请者
曾持J-1签证来美、现暂居第三国并持中华人民共和国有效因私护照的原赴美留学人员
,可依照上述办法提出申请。递交申请材料时还需提供暂居该国的有效证明。

第六条 国家公派留学人员申请者
(一)享受国家留学基金管理委员会资助的公派高级研究学者、访问学者及博士后的
豁免申请,不予受理。
(二)享受国家留学基金管理委员会资助的博士研究生、硕士研究生、本科插班生(
含本科生)、联合培养博士研究生(回国获得博士学位后重新返美),如其已与国家留
学基金管理委员会结清关系、履行协议,经国家留学基金管理委员会批准同意,可以受
理。


第七条 其他
(一)申请应由本人办理,不得委托他人(包括律师)代办;
(二)所有提交的材料必须真实、准确、齐全。如发现豁免申请材料中有伪造、虚假
材料者,将不予批准,今后亦不再受理并酌情通告有关部门;
(三)所交材料字迹清晰。申请表个人资料部分需逐项填写,不得空项。除美方提供
的英文文件或必须用英文书写的内容外,其它有关材料一律使用中文;
(四)符合要求的申请材料提交到纽约中心后,全部审批时间约需2-3个月;
(五)申请人在申请过程中如有问题,可通过电子邮件或电话向纽约中心咨询。电子

(六)在审理期间,如申请人的地址、电话变更或有其它事宜需要说明,申请人应及时
通知纽约中心,并同时通知美国国务院;
(七)驻美使馆教育处出具“不持异议信”后,如美方将信丢失,需由申请人本人要
求美方通知驻美使馆教育处补寄;
(八)中国政府出具“不持异议信”后被美方拒绝或因申请人个人原因延误向美方办
理手续的申请者,以及对曾出具“不持异议信”的申请者,驻美使领馆教育处组不再受
理第二次申请。


关于《J-1签证豁免》申请说明
J-1 签证是美国政府发给外国人来美学习、进修或从事研究工作等的签证种类之一。美

责全美“J-1签证豁免”申请的咨询与材料初审工作。自2014年3月1日起,全美启用“J
-1签证豁免”在线申请审核系统,所有申请人均须提交在线申请信息,并将书面申请材
料邮寄至“纽约中心”办理。为了方便留学人员办理,现将有关政策规定、需要准备的
材料及申请程序具体说明如下:



一、申请资格与条件



1、中华人民共和国公民,申请时持中华人民共和国有效因私护照;



2、来美途径属于留学;



3、在驻美使(领)馆教育处(组)有注册登记记录;



4、与国内原所在单位结清经济、住房等关系,并已协商解决其他未了事宜。



二、申请材料及详细说明



1、申请表与申请报告原件(请在线填写,并打印签字)。申请报告应写明原国内单位
、高中毕业后简历、留学方式(自费、单位公派或其他)、留学类别(访问学者、学生
或其他)来美后工作或学习简要情况以及申请豁免的理由;



2、申请人登录目前居留地所在领区的使(领)馆教育处(组)网站进行留学人员报到
注册, 在线填写《驻美使(领)馆教育处(组)留学人员注册登记表》并打印。暂居第三国
人员按照原在美留学单位地址确定所属领区。[在纽约中心网站注册(www.
chinesehighway.com)视同在驻美使(领)馆教育处(组)报到注册];



3、现持护照有效页复印件、来美第一次J-1签证页复印件、最近一次来美签证页复印件
及现有I-94卡正反面复印件(或电子版I-94,可在https://i94.cbp.dhs.gov/I94/
request.html下载打印)。如近期更换过护照,新、旧护照的有效页均须提供;来美第
一次J-1签证页是指来美所持的第一次J-1签证页,如更换过护照,该签证页应该在旧护
照上;最近一次来美签证页是指最近一次来美所持的签证页,可以是J-1签证,也可以
是其他类型的签证;



4、首次及目前所持DS-2019(IAP-66)表复印件;



5、美国务院豁免编号页(THIRD PARTY BARCODE PAGE)复印件。



三、申请审理程序



1、在线注册。新用户在“纽约中心”网站在线注册,并完善“我的账户”中的个人信
息和留学信息(网址是:www.chinesehighway.com);



2、在线提交申请。已注册用户请登录“纽约中心”网站进入“J-1签证豁免”申请审核
系统填写申请信息,提交在线申请;



3、打印材料清单并邮寄申请材料。在线提交申请成功后,请在线打印材料清单等材料
,并将材料清单及所有申请材料邮寄至“纽约中心”,邮寄地址如下:

注:请在信封上写明“J-1签证豁免”字样,以免延误申请。



4、“纽约中心”对材料进行整理、核查。“纽约中心”在收到申请材料后会对材料进
行整理,并核对有关基本信息,如发现缺少材料、在线申请信息填写错误等问题,“纽
约中心”会通过系统电子邮件通知申请人;



5、报驻美使(领)馆教育处(组)审核、审批。“纽约中心”在对材料进行整理及基本信
息核对后,将认为信息一致、符合要求的申请报送至相关驻美使(领)馆教育处(组)进行
审核,同意后由驻美使馆教育处代表中国政府统一向美国国务院出具“不持异议信”(
No-objection Statement),审批结果会通过系统电子邮件通知申请人。



四、审理周期



“纽约中心”收到申请材料后,需要3至5个工作日进行拆封、分类处理与录入系统,之
后会对申请材料进行整理及基本信息核对,将认为材料齐全、信息一致、符合要求的申
请材料,报送至相关驻美使(领)馆教育处(组)进行审核、审批。因与有关单位及国内联
系核查需要一定时间,整个审批时间约需2-3个月(注:如因未及时补充材料或更正信
息者,可能会导致申请延误或被拒绝)。



在线提交申请后,“纽约中心”会通过电子邮件发送确认信,请申请人在收到确认信后
30天之内将书面申请材料邮寄至“纽约中心”,请务必一次性提交完整材料。30天后“
纽约中心”仍未收到书面申请材料的,系统将自动撤销申请。从在线提交申请至审核、
审批等每个审理环节结束时,“纽约中心”会将相关进展情况通过电子邮件及时反馈给
申请人,申请人也可随时上网查询申请办理状态(网址是:www.chinesehighway.com)。



(注:“纽约中心”不受理电子邮件和传真发送的申请材料,亦不接受预约面谈和上门
递交材料。)



五、其他说明



(一)港澳地区申请者



按照“一国两制”的原则并考虑到港澳地区在户籍制度及行政管理上的实际情况,港澳
地区申请者申请时无需说明与原工作单位情况,申请材料可用中文或英文填写。



(二)暂居第三国留学人员申请者



曾经持J-1签证来美、现暂居第三国并持中华人民共和国有效因私护照的原赴美留学人
员,可依照上述办法提出申请。递交申请材料时还需提供暂居该国的有效证明。



(三)国家公派留学人员申请者



享受国家留学基金委管理委员会资助的公派高级研究学者、访问学者及博士后不可以申
请豁免。享受国家留学基金管理委员会资助的博士研究生、硕士研究生、本科插班生(
含本科生)、联合培养博士研究生(回国获得博士学位后重新返美),如其已与国家留
学基金管理委员会结清关系、履行协议,经国家留学基金管理委员会批准同意的可以申
请豁免。



(四)申请应由本人办理,不得委托他人(包括律师)代办;

时在线进行更正,并同时通知美国国务院;



(八)驻美使馆教育处出具“不持异议信”后,如美方将信丢失,需由申请人要求美方
通知驻美使馆教育处补寄;



(九)中国政府出具“不持异议信”后被美方拒绝或因申请人个人原因延误向美方办理
手续者,以及曾出具“不持异议信”的申请者,驻美使领馆教育处组不再受理第二次申
请。



六、申请费用与支付方式



自2014年4月1日起,“J-1签证豁免”收取申请费200美元。支付方式为个人支票或
Money Order,支付抬头请写NEW YORK SERVICE CENTER(请在支票或MONEY ORDER的
MEMO处注明申请人的姓名和护照号码),请将申请费与申请材料一起邮寄至“纽约中心
”。



当“纽约中心”收到申请材料进行材料整理与信息核查时,系统会自动发送“J-1签证
豁免申请已受理”的电子邮件通知申请人申请已被受理。申请一旦被受理,不论审批是
否通过,申请材料及申请费均不退回。

我可能属于3.1新规出来后率先想吃螃蟹的,把我的所见所闻和大家分享一下吧。

1 国家公派联合培养博士生(已获学位),国家公派博士生确实是可以通过大使馆办理
J1豁免了。
2 办理前提条件是和留学基金委结清所有关系。具体就是按期回国履行了协议其他内容
,但服务还不满两年的,退还全部国家资助费用(津贴,往返机票,签证费)再加30%
的违约金。
3 本人向基金委新成立的法务部递交书面申请(可传真),基金委清算明细,给基金委
账户打钱,基金委向驻美大使馆出据同意豁免公函。(这个过程1个月左右)
4 大使馆收到公函后,系统显示给纽约中心,这个时候纽约中心才会接受申请人材料并
开始办理NOS相关,再用2-3个月。
5 前面这些都办到了,NOS基本就能拿到了。这个过程没什么捷径可走,护照信息什么
的留学服务中心全有记录。

结论:以前即使有心花钱赎身,也无处赎,现在只要你有钱舍得花,终于有地方可以让
你花了。衙门有衙门的规矩,人家不管我们到底回不回,什么时候回。所以真心为了自
己的前途,还是远离J1国家公派吧。当然像楼主这样计划赶不上变化的,就只好平静接
受了。



J-1 及豁免(last updated 6/9/2010)

若干年之前,当大多数同学都是扛着 I-20 去申请 F-1 学生签证的时候,一位同学的
领导却是以 J-1 去读书。在同事中曾掀起波澜。因为只有访问学者去工作才能申请到
的 J 签证,落在了一个学生身上,于是陡然身价起来。
也不知道那位同学现在做了海龟没有。若否,则一定是办了豁免;要不,就得在国内服
务两年。

对于动辄以移民倾向相拒的 F 签证来说,J 签证可谓是太容易过了。鲜有被拒的。
而容易的背后,则是 INA 212(e) 的两年回国服务 (FOREIGN RESIDENCY REQUIREMENT).

什么是 Foreign Residence Requirement (网上也有称为 HRR - Home Residence
Requirement)?
FRR 说的是一旦你有过 J 身份,那么必须在原所在国居住两年,才能申请绿卡或其它
身份如 H/K/L, 除非获得了豁免。

在讨论豁免之前,先了解一下 J 签证是有益的。
J 签证,和其它签证类似,定义于 8 CFR 214.2(j),故名之。
J 签证是为了促进美国和其它国家之间的相互了解,专门而设的对访问学者的一种签证
。正是出于这一目的,获得该签证的人员,被要求在原国居住两年,以达到原定的交流
目的。

这个两年的要求,不仅仅是针对 J-1 本身,对其配偶、子女 J-2 也有同样的要求。
有的 J 身份不受两年之限,但同学们的 J 多是。端详你的 J 签证,或是 DS-2019 表
格,你将知道你是否有两年的要求。如果你看到了 "Bearer is not subject to
section 212(e). Two year rule does not apply",恭喜你!
即使你后来改变了身份,现在已经不再是 J 了,当曾经过的 J 身份仍有制约你的两年。

J-1 多以三年为期,现可再延两年。J 的有效停留期是 D/S, 延期直接在 SEVIS 中更
新 DS-2019 即可,不必经过移民局的插手,与 F-1 一样。
由于 J-1 的最长期与其项目有关,转换 program 的话,时间重新开始。不同的 J-1
项目,对应不同的 SEVIS 号 N0123456789. 尽管有过多次的 J-1 身份,豁免只要一次。
项目期满之后,J 有 30 天收拾行囊准备打道回国。项目延期或转换身份,必须在项目
到期之前进行。转换身份(移民局说不可但批者甚多,不解),可以去 F/B,但不能是
上面提到可以有移民倾向的 H/K/L, 更不能转绿卡。
不能转绿卡,指的是不能在境内调整身份 I-485,绿卡资格的申请 I-140 是没有问题
的。

虽然转身份,可以临时地在美国停留更长的时间,但不是长久之计。一劳永逸的解决问
题之道,是申请豁免,如果你不想回国两年来摆脱束缚。
申请豁免,有五条路可走。最常用的是 No Objection Statement (NOS).

一旦 J 豁免被批准,其 J 身份不能延期,也不宜再以 J 身份入境。否则,很可能会
需要再一次豁免。而按照中方的有关规定,“驻美使(领)馆教育处(组)不再受理第
二次申请”。

申请 NOS(不持异议信)的豁免,要通过当地的中国领馆教育处。
如果 J-1 得到了豁免,其家属 J-2 亦同时获得豁免。J-2 家属通常不能单独申请豁免
,除非是离异后的配偶。
但是如果领导也是 J-1 身份,或有过 J-1 身份的 J-2,则也需要申请自己单独的豁免
,而不能依赖于配偶另一方。
另外,豁免必须是在美国境内时申请,一旦身处境外,就只有受限于两年了。在加拿大
,等视于在美国。这是驻美国使馆教育处的规定,美国国务院无此要求。中国驻其他国
家使馆能否办理豁免,请联系其教育处。

而在实际操作当中,中方教育处还有时效规定,“申请豁免时J-1签证记录已满6个月;
申请豁免时在美,且具在美半年以上有效停留期限”。
这个“J-1签证记录已满6个月”非常费解。因为有同学是来美之后转的 J-1 身份,根
本就没有 J-1 签证。揣之,应该是指在半年之前有过 J-1 身份。而且,也没有要求必
须维持了半年的 J-1 身份。
其它规定详见“申请人的资格与条件”。
由于上面的种种规定,你可能需要挑选一个正确的时机来申办豁免。如果你现在还是 J
-1 身份,在三年过后的两年延期办好之后开始豁免,能给你更多的宽裕时间。

当你自审能够办理豁免,而且准备着手之后,就动手吧。

如果你不是手持因私护照,你得想办法换了才成。
如果你不曾在教育处注册登记,你的第一步就是做这个。下面是注册登记的连接:

第二步,申请美方豁免号

在收到领馆的申请表格之后,你就可以放心大胆地去 DOS 申请了。
因为那里有费用的要求,你不会干先交了老美钱结果发现中方连申请表都不发你的事儿
,对吧?

向美国国务院 (DOS) 申请豁免,是 Form DS-3035 J-1 VISA WAIVER RECOMMENDATION
APPLICATION. 只能在线填写,地址如下:
    https://j1visawaiverrecommendation.state.gov/

这份表格非常直观,一目了然。稍微麻烦一点的是 SEVIS Number, Program Number,
Subject/Field Code, 可以参考例表 (New DS-2019, DS-2019, IAP-66).

提交之后,将表格打印下来。你将获得一个六位数的 Case Number,如 912345. 这个
号码,将伴随你整个豁免的过程。

将签完字的 DS-3035, 一并 Check List 上的支持文件,带条形码的页面 (Third
Party Barcode Page),以及两个邮资已付地址已写的 10 号信封,同 $215 费寄往
Postal Service

申请费接受个人支票,收 Money Order 或 Cashier's Check. 申请费上请注明 Case

第三步,联系国内原单位

这一步不是所有豁免都必须的,只有出国前有单位关系的同学,才需要所谓的“国内审
批”。
这时,你得将《留学人员豁免申请表》填写个人信息后,并支持文件,寄国内原单位。

   1. 本人申请;
   2. 美方正式聘书或入学通知书;
   3. 历年IAP-66(DS2019)表复印件;
   4. 护照(新、旧)复印件;
   5. I-94卡复印件。

原单位需直接对受理申请的教育处(组)开一公函,“说明申请人派出的性质、与单位

第四步,材料寄教育处

但你收到国内回函之后,就可以将所有材料寄往领馆教育处(组)了。

   1. 《留学人员豁免申请表》;
   2. 本人书面申请报告
   3. 国内单位回函,或无需国内审批之证明;
   4. 美方机构出具的正式聘书(写明工作内容、职位、聘用期限并承诺帮助进行豁免
申请及转签证等内容)或者入学通知书(I-20表)。如与美国公民结婚,需提交经公证
的结婚证书复印件和美籍配偶的护照复印件;
   5. 历年IAP-66(DS2019)表复印件;
   6. 护照(新、旧)全本复印件;
   7. I-94卡复印件;
   8. DOS Case Number.

第五步,中方出具 NOS

寄往驻美领事馆教育组的豁免申请,最后都归结于大使馆的教育处,由大使馆教育处统
一办理。
教育处每月一次,将收到的申请公布于网。你可以通过你的 Case Number 来进行查询

除非有意外,在收到申请的当月,教育处会处理完豁免申请。批准了的豁免申请,就向
DOS 发出“不持异议信” (NOS).
同样每月一次,教育处将批准的申请公布于网。通过 Case Number 来查询:

第六步,美方 DOS 批准

当你查到你的 NOS 信发给 DOS 之后,可以到其网站查询美方的处理状态。

如果你看到的是 Department of State Decision: Pending. 没关系,只要 No
Objection Statement 是 Received 就好了。
当你看到 Department of State Decision: Favorable Recommendation, 而且
Recommendation 是 Sent 时,表明批准信已经寄出。恭喜你,豁免办成了。

DOS 的这封信是直接寄给移民局的,虽然你也会收到一份 copy. 但这个 DOS 的信不能
直接用于移民事务,诸如申请 H-1B 和绿卡。你还得等到移民局的最后批准书收到才行。

J-1 豁免成功之后,领导的 J-2 也同时豁免,除非是领导自己有过 J-1.
J-1 豁免之后,就不要再 Extend 或 Transfer,或以 J 签证重新入境。

网上有说法,把 J-1 的豁免等同于移民倾向。
如果 J-1 豁免就具有了移民倾向,那不岂不是连 F 都转不成了?

in October 2013.

I plan to travel outside US and re-enter using the current visa before the
expiration date. I also plan to submit an application for a J1 visa waiver
before I leave US for the trip. I have two questions as following.

1) Does the application for J1 visa waiver affect me using my current J1
visa to re-enter US? Or in other words, will the application for J1 visa
waiver invalidate my current J1 visa for re-entering?

2) If the application for J1 visa waiver completed and I received the
waiver
approval before I re-enter US, will my re-entering invalidate the already-
approved waiver?

原因是他夫人(J1 visa holder)2007年6月完成豁免后,2007年他8月用J2 visa入境探亲
,移民官认为他豁免失效。他夫人没有犯规,豁免仍然有效。尽管他的确回到中国居住
24个月,但是目前的这个手续很头疼。他为自己当时的无知感到悔恨。他自认倒霉遇到

No Objection Statement

Your home country’s government must issue a No Objection Statement through
its Embassy in Washington, DC that it has no objection to you not returning
to your home country to satisfy the two-year home-country physical presence
requirement and no objection to the possibility of you becoming a U.S.
lawful permanent resident. The No Objection Statement must be sent directly
to the Waiver Review Division. (Note: The No Objection Statement cannot be
provided to you, the waiver applicant, to submit to the Waiver Review
Division.) You must contact the consular section of your home country’s
embassy in Washington, DC to make this request. The No Objection Statement
may alternatively be issued by a designated ministry in your home government
and sent to the U.S. Chief of Mission, Consular Section at the U.S. Embassy
within that country. The U.S. Embassy would then forward it directly to the
Waiver Review Division.

Note:  U.S. law does not permit foreign medical physicians who acquired J-1
status on or after January 10, 1977, for the purpose of receiving graduate
medical education or training to request waivers under this basis.

Request by an Interested U.S. Federal Government Agency

The interested U.S. federal government agency request, in the form of a
letter, must be signed by the head of the agency, or his or her designee,
and submitted directly to the Waiver Review Division. (Note: The interested
U.S. federal government agency request cannot be provided to you, the waiver
applicant, to submit to the Waiver Review Division.) The letter must
explain why granting a waiver of the two-year home-country physical presence
requirement is in the public interest of the United States and why it would
be detrimental to the agency if you must return to your home country to
fulfill the requirement.

Any U.S. federal government agency may request a waiver under this basis.

Interested Government Agency Request on behalf of a foreign physician who
agrees to serve in a medically under-served area - The interested U.S.
federal government agency must send the following supporting documents
directly to the Waiver Review Division. (Note: These supporting documents
cannot be provided to you, the waiver applicant, to submit to the Waiver
Review Division.):
◦Copies of all DS-2019 /IAP-66 forms issued to you;
◦Your curriculum vitae;
◦A statement signed and dated by you that reads exactly as follows:


"I,__________(your name) hereby declare and certify, under penalty of the
provisions of 18USC.1101, that:  (1) I have sought or obtained the
cooperation of_______(enter name of U.S. Government agency which will submit
/is submitting an Interested Government Agency Waiver request on your behalf
to obtain a waiver of the two-year home-country physical presence
requirement); and (2) I do not now have pending nor will I submit another
request to any U.S. Government department or agency or its equivalent, to
act on my behalf in any matter relating to a waiver of my two-year home
residence requirement.";
◦A letter of request from the head of the agency, or a designated
official, stating why it is in the public interest that you be granted a
waiver of the two-year home-country physical presence requirement (section
212(e) of the Immigration and Nationality Act);
◦A signed contract for no less than three years and 40 hours a week
between you and the facility where you will work;
◦Evidence that the clinic/facility is located in a U.S. Department of
Health and Human Services designated Health Professional Shortage Area or
Medically Underserved Area;
◦A statement signed by the head of the facility at which you will be
employed stating the facility is located in a designated Health Professional
Shortage Area or Medically Underserved Area and provides medical care to
both Medicaid- and Medicare-eligible patients, and indigent uninsured
patients. The statement should also include the Federal Information
Processing Standards county code and census tract or block numbering area
number (assigned by the Bureau of Census) or the 9-digit zip code of the
area where the facility is located;
◦Evidence that unsuccessful efforts were made to recruit a U.S.
citizen physician for the position (for example, medical journal
advertisements; labor certification; or language in a cover letter stating
efforts to recruit a U.S. citizen physician have been unsuccessful); and
◦Form G-28 or letter from a law office, if you designated an attorney
to represent you.


Interested Government Agency Request from the Department of Veterans Affairs
(VA) on behalf of an exchange visitor physician to serve in a VA hospital:
◦VA hospitals do not have to be in an underserved area; and
◦VA applications must include a signed memorandum of agreement between
you and the hospital in lieu of a three-year contract.


Persecution

You must submit Form I-612, Application for Waiver of the Foreign Residence
Requirement directly to the U.S. Citizenship and Immigration Services (USCIS
). USCIS will forward its decision directly to the Waiver Review Division.
The Waiver Review Division will proceed with a waiver recommendation under
this basis only if USCIS makes a finding of persecution.

You may complete the waiver application with fee payment (Steps 1 and 2)
either before you submit Form I-612 to USCIS or after USCIS has informed the
Waiver Review Division that it made a finding of persecution. However, if
you complete the waiver application, online Form DS-3035, and pay the
nonrefundable fee before you submit Form I-612 to USCIS, you will not
receive a refund of the application fee in the event that USCIS does not
make a persecution finding.

Exceptional Hardship to a U.S. citizen (or lawful permanent resident) spouse
or child

Note: Mere separation from your U.S. citizen (or lawful permanent resident)
spouse or child is not considered to be sufficient to establish exceptional
hardship.

You must submit Form I-612, Application for Waiver of the Foreign Residence

      前几天,一位来自北加州名校的印度教授来到了我们位于硅谷的办公室,咨询了J
-1签证2年回国限制(既在J-1签证到期后需要回居住国2年)的相关事宜。因为他选择
的是Premium Silver Key的服务,所以它能够直接指定张哲瑞律师作为他的咨询律师,
张律师也热情并专业的解决了他的烦恼。
      他的基本状况是:他打算在J-1访问学者签证到期后回到了印度,并想着手申请
NIW,他的J-1签证有两年回国限制。 他的妻子在美国持H-1B签证工作。因为NIW的申请
是一个漫长的过程,并且需要先申请J签证2年回国限制的waiver,所以他想在回到印度
处理相关事宜后通过H-4签证回到美国,再着手申请移民身份。他十分想在没有Waiver
的情况下直接申请H-4签证以尽快来美国与家人团聚,但是在做了很多研究后还是没有
完全明白这样是否可行,因此在朋友的推荐下选择咨询张律师
       张律师在耐心的了解了所有情况后,十分肯定的告诉这位教授可以在没有
waiver的情况下直接申请H-4。这个回答让这位印度教授又惊又喜,惊的是他之前在网
上做过的调查大都是与张律师的意见相反的,喜的是既然如此有经验的张律师这么认为
,他就很有可能回美国与妻子团聚了。
然而,这位教授在咨询后仍不放心,又发邮件给张律师,希望张律师能发送给他有关法
律条文来证明他的H-4申请确实不会受到影响。因为他在移民论坛与别人分享了张律师
的判断后,很多会员都不同意张律师的意见。
      张律师欣然答应,为这位教授分析了有关法律条文,具体如下:
      1. According to Title 22, Part 40, Section 40.202 of the Code of
Federal Regulations,an alien who is subject to the 2-year foreign residency
requirement "is not eligible to apply for or receive an immigrant visa or a
nonimmigrant visa under INA 101(a) (15) (H), (K), or (L), notwithstanding
the approval of a petition on the alien's behalf..."
      很多论坛的会员也是根据这一点说这位教授不能直接申请H-4而需要先申请
waiver. 然而:
      2. According to INA 101 (a) (15) (H), which is mentioned above, H-4
non-immigration visa is not included in the H category. So that means the
regulation did not prohibit the professor from apply for H-4 visa.

转换身份,而需要回到自己国家通过申请其他签证(如H-4,L-2,F等)来返美。


Q.What is the "two-year rule?"

The "two-year rule" is the common term used for a section of U.S.
immigration law which requires many exchange visitors to return to their
home countries and be physically present there for at least two years after
the conclusion of their exchange visit before they can return to the U.S.
under certain types of visas, specifically H-1, L-1, K-1 and immigrant visas
. It is important to note that only a preliminary finding of whether the two
-year rule applies to you is made on your DS-2019 when your J-1 visa is
issued. The final decision will be made only if you later choose to apply
for an H-1, L-1, K-1, or immigrant visa.

J-1 visa holders subject to the two-year rule are not permitted to remain in
the United States and apply for an adjustment/change of status to a
prohibited nonimmigrant status (for example, from a J-1 visa to an H-1 visa)
or to apply for legal permanent resident status (Green Card) without first
returning home for two years or obtaining an approved waiver. Whether you
are subject to the two-year rule is determined by a number of factors,
including your source of funding and your country's "Skills List."" It is
not determined by the amount of time you spend in the United States.

Physical Presence Requirement

As part of your DS-3035 Application for Recommendation of a J-1 Waiver of
the two-year home-country physical presence requirement, also known as the
foreign residence requirement, you must pay a processing fee of US$215.00.

THE PROCESSING FEE IS NON-REFUNDABLE.

A check or money order must be made payable to the U.S. Department of State
and must include the following information:

    Your waiver case number, if known;
    Your full name;
    Your date and place of birth; and
    Your social security number, if you have one.

Important Information about Fee Payment

    Your check or money order must be drawn on a bank or other institution
located in the U.S. and must be made payable in U.S. currency to the U.S.
Department of State.
    If you reside outside the U.S. at the time of application, payment may
be made by a bank international money order or a foreign draft drawn on an
institution in the U.S. and must be made payable to the U.S. Department of
State in U.S. currency.
    You must submit your check or money order with your waiver application,
as explained in Step 2 of the Instructions webpage for how to apply for a

不好意思, 急问个问题, 那个已经成功的waiver不会失效有没有啥出处么. 我的waiver
今年6月1号approval, 然后在国内6月9号申请了新的J-1 visa, 新visa的issue
date是6月30号. 但是上面仍然写的是212(E) Two Year Rule Applies. 现在申请
转H-1b的时候, 学校坚持说因为我申请了新的J-1 Visa, 所以就自动导致了我的waiver
失效, 到底是不是这样呀.

第一条 J-1 签证及其豁免
J-1 签证是美国移民局发给外国人来美学习、进修或从事研究工作等的签证种类之一。
美国政府规定,凡持 J-1 签证来美的人员,在美停留期满后必须返回原所在国居住两
年。由于某些原因在美停留期限需超过签证规定时间的人员,应向美国政府提出免除返
回原所在国居住两年限制的豁免申请,但首先须得到原所在国政府的批准。

中国驻美大使馆及各总领馆代表中国政府受理和审批持J-1签证中国公民的豁免申请。
具体审批事宜由中国驻美使领馆教育处组(以下简称驻美使领馆教育处组)根据有关规
定负责办理。


第二条 申请人的资格与条件
(一)中华人民共和国公民,申请时持中华人民共和国有效因私护照;

(二)来美途径属于自费留学或单位公派;

(三)在美有J-1签证记录,申请豁免时J-1签证记录已满6个月;

(四)申请豁免时在美,且具在美半年以上有效停留期限;

(五)在驻美使领馆教育处组有注册登记记录;

(六)与国内原所在单位结清经济、住房等关系,并已协商解决其他未了事宜。

第三条 申请及受理程序
(一) 提交申请材料。

1、申请人在驻美使领馆教育处组网站上下载《留学人员豁免申请表》,并填写表格;

2、本人书面申请报告;

3、原国内同意函件及其它证明文件(详见“第四条”);

4、美方机构出具的正式聘书;

5、护照有效页、历次来美签证页、I-94卡复印件;

6、来美的历次IAP-66(DS2019)表的复印件;

7、美国务院豁免编号页。

8、一个贴好邮票、写好回邮地址的标准信封。

(二)申请人将所有申请材料邮寄给驻美使领馆教育处组。

(三)驻美使领馆教育处组对材料进行审核,同意后由驻美使馆教育处代表中国政府统
一向美国国务院出具“不持异议信”(No-objection Statement),并由各驻美使领馆
教育处组将结果通知申请人。



第四条 国内审批事项

(一)属下列情况的申请者,提交国内有关审批证明文件:

1、申请人出国前已办理《具有大学专科和大学专科以上学历人员自费出国留学审核表
》(简称JW-109表),只需提供此表;

2、申请人出国前系普通高等学校全日制毕业生,能够出具本人毕业证书(复印件)或
者其它合法有效证明材料,以证明毕业时间与出国时间相连续的(半年以内),无需提
交国内审批文件;

3、申请人国内学校毕业后无工作单位来美者,提交申请人国内就读学校学生工作部门
或者档案管理部门出具的正式公函;

4、申请人人事档案现已转到人才交流中心者, 提交原单位出具的关于申请人辞职、离
职、辞退或除名的证明文件。

(二)申请人派出单位或档案管理部门向驻美使领馆教育处组出具的正式公函应说明申
请人派出性质、与单位是否结清经济关系、住房关系及是否有其它未了事宜等。

第五条 申请材料说明
(一)按规定填写完整的《申请表》;

(二)申请人书面申请报告。应写明原国内单位、留学方式(自费或单位公派)、来美
后工作或学习简要情况以及申请豁免的理由;

(三)国内有关部门出具的单位公函原件或者申请人辞职(离职、辞退、除名)的证明
文件复印件、JW-109表的复印件、毕业证书的复印件等前述第四条所需材料;

(四)美方机构出具的正式聘书(写明工作内容、职位、聘用期限并承诺帮助进行豁免
申请及转签证类别等内容)或者入学通知书(I-20表)。如与美国公民结婚,需提交经
公证的结婚证书复印件和美籍配偶的护照复印件;

(五)护照有效页和历次来美签证页复印件;

(六)来美历年IAP-66(DS2019)表复印件;

(七)申请豁免时尚具在美半年以上有效停留证明;

(八)现有的I-94卡正反面复印件;

(九)美国国务院发放的豁免编号通知单(THIRD PARTY BARCODE PAGE)。

第六条 港澳地区申请者
按照“一国两制”的原则并考虑到港澳地区在户籍制度及行政管理上的实际情况,港澳
地区申请者申请时不需出具原工作单位证明,申请材料可用中、英文填写。

第七条 暂居加拿大申请者
曾经持J-1签证来美、现暂居加拿大并持中华人民共和国有效因私护照的中国公民可依
照上述办法,直接向中国驻美大使馆教育处提出申请。递交申请材料时还需提供暂居加
拿大的有效证明。

第八条 其它
(一)凡国家公派留学人员,包括曾在第三国留学的国家公派留学人员,回国服务未满
两年者的豁免申请均不予受理。

(二)申请应由本人办理,不得委托他人(包括律师)代办;

(三)所有提交的材料必须真实、准确、齐全。如发现豁免申请材料中有伪造、虚假材
料者,将不予批准,今后亦不再受理并酌情通告有关部门;

(四)所交材料字迹清晰。申请表个人资料部分需逐项填写,不得空项。除美方提供的
英文文件或必须用英文书写的内容外,其它有关材料一律使用中文;

(五)符合要求的申请材料提交到驻美使领馆教育处组后,全部审批时间约需3-5个月;

(六)申请人如有疑问,请及时与所在驻美使领馆教育处组有关官员联系。对有问题的
申请材料,驻美使领馆教育处组将及时通知申请人。驻美使领馆教育处组不受理关于一
般审批进展情况的查询;

(七)在审理期间,如果申请人的地址、电话变更或有其它事宜需要说明,申请人应及
时通知驻美使领馆教育处组的有关官员,并同时通知美国国务院;

(八)驻美使馆教育处出具“不持异议信”后,如美方将信丢失,需由申请人要求美方
通知驻美使馆教育处补寄;

(九)出具“不持异议信”后被美方拒绝或因某种原因延误向美方办理手续者,以及曾
出具“不持异议信)者,驻美使领馆教育处组不再受理第二次申请。


TYPES OF J-1 CATEGORIES

Short-Term

•Purpose of visit: lecture, observe, consult, train staff, demonstrate
special skill(s)
•Current position in home country: Professor, researcher (post-doc or
pre-doc/graduate student), or someone with similar credentials (Doctor,
attorney, etc.)
•Duration of U.S. visit: 1 day - 6 months
•Individual may return in this category an unlimited number of times

Research

•Purpose of visit; research, observe, consult, teach, capacity in
connection with a research project
•Current position in home country: Professor, researcher (post-doc or
pre-doc/graduate student), or someone with similar credentials (Doctor,
attorney, etc.)
•Duration of U.S. visit: 3 weeks - 5 years
•Individual is subject to the 24 Month Bar  (See below under '
Important J-1 Visa Regulations' for more information)
Professor

•Purpose of visit: teach (primary), lecture, observe, consult,
research
•Current position in home country: Professor, researcher (post-doc or
pre-doc/graduate student), or someone with similar credentials (Doctor,
attorney, etc.)
•Duration of U.S. visit: 3 weeks - 5 years
•Individual is subject to the 24 Month Bar (See below under 'Important
J-1 Visa Regulations' for more information)

Intern

•Purpose of visit: participate in a structured internship program
•Position in home country: undergraduate student
•Duration of U.S. visit: 1 day - 12 months
•Individual may return in this category in a different internship
program

Trainee

•Purpose of visit: participate in a structured internship program

working in internship field

IMPORTANT J-1 VISA REGULATIONS
212 (e) - 2 year Home Residency Requirement

What does it mean to be subject to 212 (e), two-year home residency
requirement?

•Scholar is not eligible to obtain an H or L visa at a U.S. consular
office, or to change to these visa categories within the U.S. before
fulfilling this requirement
•Scholar is not eligible for lawful permanent residence status before
fulfilling this requirement.
•Scholar is not eligible to change status from J-1 to any other
nonimmigrant status from within the U.S. before fulfilling this requirement.
Any change of status must be done by exiting and re-entering the U.S. in
the new status.
•Please note that 212(e) will still apply to your record until the
requirement has been waived or fulfilled.
What does a scholar have to do to fulfill this requirement?

•After the completion of the J-1 program in the U.S., J-1 scholars
subject to the 212(e) must spend two years physically present in your
country of citizenship or last legal permanent residence. Time does not have
to be continuous.
Which J-1 scholars are subject to 212e?

•Any scholar whose field of study is on the Exchange Visitor Skills
List through the Department of State. Please be advised that the IO
recommends that all scholars check the Skills List even if your
documentation does not reflect subjectivity.
•Any scholar receiving U.S. or home government funding.
•Any scholar receiving graduate medical education or training.
Can a scholar have this requirement waived?

•Yes, the waiver process should be initiated and filed by the EV and
not by the International Office. More information on this waiver process can
be found on the Department of State site.
**If an you were subject to the 212(e), two year home residency requirement,
and you have received a written waiver recommendation from the US
Department of State, then you are not eligible for an extension beyond the
current end date of your DS-2019.**


24 Month Bar

Who is subject to the 24 month bar?

•Scholars who are currently in the J-1 Research Scholar or Professor
category, or who have been in the J-1 Research Scholar or Professor category
in the past 24 months.
What does it mean to be subject to the 24 month bar?

•The 24 month bar is meant to bar individuals from repeat
participation in the J-1 exchange program.
•After the end of your J-1 program, you cannot return to the U. S. in
the J-1 Research Scholar or Professor category for 24 months.
•This does not bar you from entering in the J-1 Short-term category,
or in other nonimmigrant statuses.
•If you are a J-1 scholar in the Research Scholar or Professor
category, and you plan to make annual or other periodic trips to
Northwestern, please speak with the International Office before leaving the
U.S.
•Note: If you entered the U.S. on a J-1 visa prior to November 2006
you are subject to a 12 month bar not the 24 month bar.  For more
information contact the IO.
When does the 24 month bar go into effect?

•The 24-month bar will apply to you regardless of whether you were in
status for only a few months or for the full five year limit of the J-1
program.
•The 24 month bar goes into effect when your J-1 program finishes and
your record in SEVIS goes inactive.
•To take advantage of the full five years of the -1 Research Scholar
or Professor category, you would need to have an appointment of five
continuous years to keep your SEVIS record active.
Which EV's are subject?

•All EV's in the Research Scholar, Professor category
•Trainees may participate in additional training programs only after
residing outside the United States for at least 2 years following your last
training program

Understanding the 12 and 24 Month Bars
The U.S. State Department has implemented regulations that prevent repeat
usage of some J Exchange Visitor categories. The regulations are called the
12 and 24 month “bars” or prohibitions. The bars focus only on use of the
Research Scholar or Professor category of the J visa. The bars do not
prevent access to other visas or other categories of the J Exchange Visitor
Program. Finally these bars are entirely separate from the “Two-Year Home-
Residency” requirement wherein some J visa holders must return to their
home country before being able to move to other U.S. visa types. Below is a
discussion of the 12 and 24 month bars.

12 Month Bar 
Individuals who have been in the U.S. for more than six months in the
previous year with J-1 or J-2  visa status are not eligible to enter the
United States again as a J-1 Research Scholar or Professor for a 12-month
period. The only exception is if the first visit was using the J-1 Short
Term Scholar category, which does not count towards the 12-month bar. The 12
-month bar does not prevent individuals from returning to the U.S. in other
visa status (F-1, B-1, H-1B, O-1, etc…) To see a chart of the 12 and 24

24 Month Bar
Any individual who participates in a J-1 Exchange Visitor program in the
Professor or Researcher Scholar categories is subject to a 24-month bar on
“repeat participation” in that same category. Scholars subject to the bar
may not return to the U.S. as a J-1 visa holder in the Professor or Research
Scholar categories for the 24-month period. The 24-month bar occurs
regardless of whether the program in the US is a few months or a few years.
Whenever an Exchange Visitor ends his/her academic appointment and returns
home the bar becomes effective. For example, both the professor who comes to
Yale for 3 years and the researcher who visits for 8 months, would after
returning home be prevented from returning again to the US with a new J
Researcher Scholar or Professor visa for 24 months. This bar also applies to
family members who held J-2 Research Scholar or Professor dependent status.
  The 24-month bar does not prevent individuals from returning to the United
States in any visa status (F-1, B-1, H-1B, O-1, etc…) To see a chart of
