If your husband is laid off and not fired for cause, the employer is
required to arrange for your transportation (and moving costs) out of
the U.S., in accordance with federal law. Keep this in mind if you
have no choice but to leave the U.S.
The more useful thing to do is to ask the employer to keep your husband
on paid or unpaid vacation leave and not revoke his I-797A/B approval
immediately, then ask the new employer to file I-907 for premium
processing. USCIS should be able to approve the new H-1B petition within
two weeks.
If the old employer revokes the I-797A/B right away after laying off
your husband, and this happens before USCIS approves the new H-1B
petition, then when the new H-1B petition is finally approved by USCIS,
it will be approved for consular processing on an I-797B, which forces
your husband (and you and your children if you are H-4) to leave the
U.S. to apply for new H visas.
